Background Section 327 of Title 23, United States Code (23 U.S.C. 327), allows the Secretary of the DOT, to assign, and a State to assume, the Secretary’s National Environmental Policy Act of 1969 (NEPA) responsibilities and all or part of the Secretary’s responsibilities for environmental review, consultation, or other actions required under any other Federal environmental law with respect to one or more Federal-aid highway projects. The FHWA is authorized to act on behalf of the Secretary with respect to these matters. The State has submitted application materials requesting to participate in this Program. The FHWA has reviewed these application materials, which include public and Agency comments on the application, and has determined them complete. The FHWA and the State developed a draft MOU outlining how the State will implement the Program and how FHWA will oversee the State’s implementation as required by 23 U.S.C. 327.     Description of Relief Sought: To allow the use of a single long-
range communication system (LRCS) utilizing voice communications as 
defined in 14 CFR Par 1.1. Any LRCS used to satisfy the requirements of 
the exemption, shall be a system authorized for use in the DXTK401D 
Management Specifications. If granted, this relief from 14 CFR 
91.511(d) shall apply to any aircraft operated in the NJA Fractional 
Program (DXTK401D) under 14 CFR part 91 subpart k, within the U.S. NAS 
and international airspace. NJA extended overwater operations occur 
outside the U.S. NAS.
