Congressional Review Act This final rule is not a major rule as defined by section 804 of the Small Business Regulatory Enforcement Fairness Act of 1996 (Congressional Review Act (CRA)). This rule will not result in: An annual effect on the economy of $100,000,000 or more; a major increase in costs or prices for consumers, individual industries, Federal, State, or local government agencies, or geographic regions; or significant adverse effects on competition, employment, investment, productivity, innovation, or on the ability of United States-based enterprises to compete with foreignbased enterprises in domestic and export markets. However, pursuant to the CRA, the DEA has submitted a copy of this final rule to both Houses of Congress and to the Comptroller General. Determination To Make Rule Effective Immediately The DEA is making the rule effective on the date of publication in the Federal Register as allowed under the good cause exception in 5 U.S.C. 553(d)(3). This final rule amends the regulations to permanently control betahydroxythiofentanyl in schedule I of the CSA. This action continues control of the substance as it is currently controlled until May 12, 2019 by virtue of the temporary scheduling order (83 FR 21834, May 10, 2018). The May 2018 temporary scheduling order extended temporary control of the substance, which was first established in the May 10, 2016, final order. 81 FR 29492. That May 2016 final order was effective on the date of publication, and was based on findings by the Acting Administrator of the DEA that the temporary scheduling of beta-hydroxythiofentanyl was necessary to avoid an imminent hazard to the public safety pursuant to 21 U.S.C. 811(h)(1). Therefore, the DEA believes it is unnecessary and contrary to the public interest to delay the effectiveness of this final rule by 30 days. the Black River in South Haven, Michigan for the Harborfest Dragon Boat 
Race on June 15, 2019. This action is necessary and intended to protect 
the safety of life and property on navigable waters prior to, during, 
and immediately after the boat race. During the enforcement period 
listed below vessels and persons are prohibited from transiting 
through, mooring, or anchoring within the special local regulation 
unless authorized by the Captain of the Port Lake Michigan or a 
designated representative. The operator of any vessel in the regulated 
area must comply with directions from the Patrol Commander or any 
Official Patrol displaying a Coast Guard ensign.
