The notifications were filed for the purpose of extending the Act’s provisions limiting the recovery of antitrust plaintiffs to actual damages under specified circumstances. Specifically, Vigor Marine LLC, Seattle, WA, has been added as a party to this venture. No other changes have been made in either the membership or planned activity of the group research project. Membership in this group research project remains open, and NSRP intends to file additional written notifications disclosing all changes in membership. On March 13, 1998, NSRP filed its original notification pursuant to Section 6(a) of the Act. VerDate Sep<11>2014 18:51 May 01, 2019 Jkt 247001 ExxonMobil Pipeline Company, Civil Action No. 1:19–cv–00048–SPW–TJC. The United States filed this lawsuit against ExxonMobil Pipeline Company (‘‘ExxonMobil’’) seeking civil penalties pursuant to Section 311(b)(7)(A) and (D) of the Clean Water Act (‘‘CWA’’), 33 U.S.C. 1321(b)(7)(A) and (D), and injunctive relief pursuant to Section 309(b) of the CWA, 33 U.S.C. 1319(b), as a result of the July 1, 2011 discharge of over 1,500 barrels of crude oil from the company’s Silvertip Pipeline into the Yellowstone River near Laurel, Montana. The proposed Consent Decree requires ExxonMobil Pipeline Company to pay a civil penalty of $1,050,000 to resolve the claims. The settlement proceeds will be deposited in the Oil Spill Liability Trust Fund. The proposed Consent Decree also requires ExxonMobil to take action at certain Silvertip Pipeline water crossings. The publication of this notice opens a period for public comment on the consent decree.
