The Regional Administrator is required
to consider the criteria in
§ 648.102(c)(2)(i)(A) through (C) in the
evaluation of requests for quota transfers
or combinations.
North Carolina is transferring 3,270 lb
(1,483 kg) of summer flounder
commercial quota to New Jersey through
mutual agreement of the states. This
transfer was requested to repay landings
made by a North Carolina-permitted
vessel in New Jersey under a safe harbor
agreement. Based on the initial quotas
published in the 2019 Summer
Flounder, Scup, and Black Sea Bass
Specifications, the revised summer
flounder quotas for fishing year 2019 are
now: North Carolina, 1,827,368 lb
(828,880 kg); and New Jersey, 1,118,827
lb (507,491 kg).
Classification
This action is taken under 50 CFR
part 648 and is exempt from review
under Executive Order 12866.

SUPPLEMENTARY INFORMATION: NMFS

fishery under the Fishery Ecosystem
Plan for the Hawaiian Archipelago. The
regulations at 50 CFR 665.252(b) require
NMFS to publish an annual harvest
guideline for lobster Permit Area 1,
comprised of Federal waters around the
NWHI.
Regulations governing the
Papahanaumokuakea Marine National
Monument in the NWHI prohibit the
unpermitted removal of monument
resources (50 CFR 404.7), and establish
a zero annual harvest guideline for
lobsters (50 CFR 404.10(a)).
Accordingly, NMFS establishes the
harvest guideline for the NWHI
commercial lobster fishery for calendar
year 2018 at zero lobsters. Harvest of
NWHI lobster resources is not allowed.
