Under the provisions of the
Paperwork Reduction Act, the
Regulatory Secretariat Division will be
submitting to the Office of Management
and Budget (OMB) a request to review
and approve an existing OMB
emergency clearance notice concerning
North Carolina sales tax certification.

The Federal Acquisition Regulation
(FAR) clause at 52.229–2, North
Carolina State and Local Sales and Use
Tax, requires contractors for
construction or vessel repair to be
performed in North Carolina to provide
certified statements setting forth the cost
of the property purchased from each
vendor and the amount of sales or use
taxes paid.
The North Carolina Sales and Use Tax
Act authorizes counties and
incorporated cities and towns, to obtain
each year from the Commissioner of
Revenue of the State of North Carolina,
a refund of sales and use taxes
indirectly paid on building materials,
supplies, fixtures, and equipment that
become a part of or are annexed to any
building or structure in North Carolina.
However, to substantiate a refund claim
for sales or use taxes paid on purchases
of building materials, supplies, fixtures,
or equipment by a contractor, the
Government must secure from the
contractor certified statements setting
forth the cost of the property purchased
from each vendor and the amount of
sales or use taxes paid. Similar certified
statements by subcontractors must be
obtained by the general contractor and
furnished to the Government.

A 60-day notice published in the
Federal Register at 83 FR 51953 on
October 15, 2018. No comments were
received.

ACTION:
Notice.
The Food and Drug
Administration (FDA) is announcing the
issuance of an Emergency Use
Authorization (EUA) (the Authorization)
for an in vitro diagnostic device for
detection of Ebola virus (species Zaire
ebolavirus and hereafter referred to as
Ebola virus) in response to the Ebola
virus outbreak in the Democratic
Republic of the Congo. FDA issued this
Authorization under the Federal Food,
Drug, and Cosmetic Act (the FD&C Act),
as requested by Chembio Diagnostic
Systems, Inc. The Authorization
contains, among other things,
conditions on the emergency use of the
authorized in vitro diagnostic device.
The Authorization follows the
September 22, 2006, determination by
then-Secretary of the Department of
Homeland Security (DHS), Michael
Chertoff, that the Ebola virus presents a
material threat against the U.S.
population sufficient to affect national
security. On the basis of such
determination, the Secretary of Health
and Human Services (HHS) declared on
August 5, 2014, that circumstances exist
justifying the authorization of
emergency use of in vitro diagnostic
devices for detection of Ebola virus,
subject to the terms of any authorization
issued under the FD&C Act. The
Authorization, which includes an
explanation of the reasons for issuance,
is reprinted in this document.

of November 9, 2018.
