The Environmental Protection
Agency (EPA) has submitted an
information collection request (ICR),
NESHAP for Flexible Polyurethane
Foam Product (EPA ICR No. 1783.09,
OMB Control No. 2060–0357), to the
Office of Management and Budget
(OMB) for review and approval in
accordance with the Paperwork
Reduction Act. This is a proposed
extension of the ICR, which is currently
approved. Public comments were
previously requested, via the Federal
Register, on June 29, 2017 during a 60day comment period. This notice allows
for an additional 30 days for public
comments. A fuller description of the
ICR is given below, including its
estimated burden and cost to the public.
An agency may neither conduct nor
sponsor, and a person is not required to
respond to, a collection of information
unless it displays a currently valid OMB
control number.
DATES: Additional comments may be
submitted on or before March 13, 2019.

Abstract: The National Emission
Standards for Hazardous Air Pollutants
(NESHAP) for Flexible Polyurethane
Foam Product (40 CFR part 63, subpart
III) apply to owners or operators of both
new and existing facilities that engage
in the manufacture of flexible
polyurethane foam products which emit
hazardous air pollutants (HAPs). This
includes facilities making slabstock
flexible polyurethane foam (slabstock
foam), rebond flexible polyurethane
foam (rebond foam), and/or molded
flexible polyurethane foam (molded
foam). In general, all NESHAP standards
require initial notifications,
performance tests, and periodic reports
by the owners/operators of the affected
facilities. Owners or operators of
flexible polyurethane foam production
facilities to which this rule is applicable
must choose one of the compliance
options described in these standards or
reduce HAP emissions to below the
compliance level. Specifically, the rule
requirements for slabstock foam
producers include an initial
notification, notification of compliance
status, semiannual reports and annual
compliance certifications. The rule
requirements for molded and rebond
foam producers include a notification of
compliance status report and an annual
compliance certification. These
notifications, reports, and records are
essential in determining compliance
with 40 CFR part 63, subpart III.

Respondents/affected entities:
Manufacturers of flexible polyurethane
foam products.
Respondent’s obligation to respond:
Mandatory (40 CFR part 63, subpart III).
Estimated number of respondents: 12
(total).
Frequency of response: Initially,
annually, and semiannually.
Total estimated burden: 869 hours
(per year). Burden is defined at 5 CFR
1320.3(b).
Total estimated cost: $94,700 (per
year), includes which $0 for annualized
capital/startup and/or operation &
maintenance costs.
Changes in the Estimates: There is an
adjustment decrease in the total
estimated burden as currently identified
in the OMB Inventory of Approved
Burdens. The decrease is not due to any
program changes. The change in burden
hours and number of responses is a
result of removing burden for
reconstructed sources as no
