examinations as a condition of
employment. This information is
needed to ensure fair and consistent
treatment of employees and job
applicants, to adjudicate the medically
based passover of a preference eligible,
and to adjudicate claims of
discrimination under the Americans
with Disabilities Act (ADA).

Plus Data Feeds’’ into the market data
enterprise license proposed by the
Nasdaq Stock Market LLC (‘‘Nasdaq’’),
which is designed to lower fees, reduce
administrative costs, and expand the
availability of Nasdaq Last Sale (‘‘NLS’’)
Plus, NLS, Nasdaq Basic and Nasdaq
Depth-of-Book products. The proposal is
described in further detail below.
The text of the proposed rule change
