Applicant’s Proposed Project We received an application for an ITP, along with a proposed HCP. The applicant requests a 2-year permit under section 10(a)(1)(B) of the ESA (16 U.S.C. 1531 et seq.). If we issue the permit, the applicant anticipates taking 1.41 acres of scrub-jay breeding, feeding, and sheltering habitat for construction of six single-family residences and associated infrastructure in North Port, Sarasota County, Florida. The applicant proposes to mitigate for the loss of 1.41 acres of occupied scrubjay habitat through the purchase of 2.82 credits from a Service-approved conservation bank within 30 days of permit issuance. sradovich on DSK3GMQ082PROD with NOTICES Our Preliminary Determination The Service has made a preliminary determination that the applicant’s project, including the proposed mitigation and minimization measures, will individually and cumulatively have a minor or negligible effect on the species covered in the HCP. Therefore, issuance of the ITP is a ‘‘low-effect’’ action and qualifies as a categorical exclusion under the National Environmental Policy Act (NEPA), as provided by 43 CFR 46.205 and 46.210. A low-effect HCP is one involving; (1) minor or negligible effects on federally listed, proposed, and candidate species and their habitats; (2) minor or negligible effects on other environmental values or resources; and (3) impacts when, considered together with the impacts of other past, present, and reasonably foreseeable similarly situated projects, would not result over time in cumulative effects to environmental values or resources that would be considered significant. Next Steps We will evaluate the HCP and comments we receive to determine whether the ITP application meets the requirements of section 10(a)(1)(B) of the ESA. We will also conduct an intraService consultation to evaluate take of the scrub-jay in accordance with section 7 of the ESA. If the requirements are met we will issue ITP number TE84046C–0 to the applicant.
