(Complainant) filed a formal complaint against New York Independent System Operator, Inc. (Respondent) alleging that the Respondent is improperly applying its Market Administration and Control Area Services Tariff by allowing resources in the PJM Interconnection, L.L.C. market to deliver installed capacity (ICAP) to New York across merchant transmission facilities that are not qualified to deliver ICAP to New York, all as more fully explained in the complaint. The Complainant certifies that copies of the complaint were served on the contacts for the Respondent as listed on the Commission’s list of Corporate Officials. Any person desiring to intervene or to protest this filing must file in accordance with Rules 211 and 214 of the Commission’s Rules of Practice and Procedure (18 CFR 385.211, 385.214). and Procedure, 18 CFR 385.206, Independent Power Producers of New York, 
Inc. (Complainant) filed a formal complaint against New York 
Independent System Operator, Inc. (Respondent) alleging that the
