No written comments were solicited
or received with respect to the proposed
rule change.
III. Date of Effectiveness of the
Proposed Rule Change and Timing for
Commission Action
Because the proposed rule change
does not (i) significantly affect the
protection of investors or the public
interest; (ii) impose any significant
burden on competition; and (iii) become
operative for 30 days from the date on
which it was filed, or such shorter time
as the Commission may designate, it has
become effective pursuant to Section
19(b)(3)(A) of the Act 16 and Rule 19b–
4(f)(6) thereunder.17
A proposed rule change filed
pursuant to Rule 19b–4(f)(6) under the
Act 18 normally does not become
operative for 30 days after the date of its
filing. However, Rule 19b–4(f)(6)(iii) 19
permits the Commission to designate a
shorter time if such action is consistent
with the protection of investors and the
public interest. The Exchange has asked
the Commission to waive the 30-day
operative delay to allow the Exchange to
immediately update the Independence
Policy to reflect the Transaction and to
remove obsolete references. The
Commission does not believe that any
new or novel issues are raised by the
proposal. For these reasons, the
Commission believes that the waiver of
the operative delay is consistent with
the protection of investors and the
public interest. Therefore, the
Commission hereby waives the 30-day
operative delay and designates the
proposal operative upon filing.20
At any time within 60 days of the
filing of the proposed rule change, the
Commission summarily may
temporarily suspend such rule change if
it appears to the Commission that such

BNSF Railway Company (BNSF), and
Norfolk Southern Railway Company
(NSR) (collectively, Applicants), have
jointly filed a verified notice of
exemption under 49 CFR pt. 1152
subpart F—Exempt Abandonments and
Discontinuances of Service for BNSF to
abandon, and for NSR to discontinue
service over, approximately 0.45 miles
of rail line between milepost 67.38 and
milepost 66.93 in the City of Des
Moines, Polk County, Iowa (the Line).
The Line traverses United States Postal
Service Zip Code 50309.
Applicants have certified that: (1) No
local rail traffic has moved over the Line
for at least two years; (2) no overhead
rail traffic has moved over the Line for
at least two years; (3) no formal
complaint filed by a user of rail service
on the Line (or by a state or local
government entity acting on behalf of
such user) regarding cessation of service
over the Line either is pending with the
Surface Transportation Board (Board) or
with any U.S. District Court or has been
decided in favor of complainant within
the two-year period; and (4) the
requirements at 49 CFR 1105.7(c)
(environmental report), 49 CFR 1105.11
(transmittal letter), 49 CFR 1105.12
(newspaper publication), and 49 CFR
1152.50(d)(1) (notice to governmental
agencies) have been met.
As a condition to these exemptions,
any employee adversely affected by the
abandonment shall be protected under
Oregon Short Line Railroad—
Abandonment Portion Goshen Branch
Between Firth & Ammon, in Bingham &
Bonneville Counties, Idaho, 360 I.C.C.
91 (1979). To address whether this
condition adequately protects affected
employees, a petition for partial
