SUPPLEMENTARY INFORMATION:
Background: The Secretary of
Transportation (Secretary) is authorized
to require marking of vehicles and
intermodal equipment by motor carriers,
freight forwarders and intermodal
equipment providers (IEPs) engaging in
interstate transportation based on the
authority of 49 U.S.C. 31133(a)(8) and
31133(a)(10). The Secretary has
delegated authority pertaining to the
marking of commercial motor vehicles
(CMVs) pursuant to 49 CFR 1.87(f). The
Agency’s regulation governing the
marking of CMVs is codified at 49 CFR
390.21.
Vehicle marking requirements are
intended to ensure that FMCSA, the
National Transportation Safety Board
(NTSB), and State safety officials are
able to identify motor carriers and
correctly assign responsibility for
regulatory violations during inspections,
investigations, compliance reviews, and
crash studies. These marking
requirements will also provide the
public with beneficial information that
could assist in identifying carriers for
the purposes of commerce, complaints
or emergency notification. The marking
requirements apply to motor carriers,
freight forwarders and intermodal
equipment providers (IEPs) engaging in
interstate transportation. The Agency
does not require a specific method of
marking as long as the marking
complies with FMCSA’s regulations.
The program change decrease of 76,751
estimated annual burden hours (774,249
proposed estimated annual burden
hours—851,000 approved estimated
annual burden hours) is due to
adjustments in respondent and response
estimates, as well as the removal of
initial marking burden from the
adoption of the ‘‘Lease and Interchange
of Vehicles; Motor Carriers of
Passengers’’ final rule.

II. Legal Basis
FMCSA has authority under 49 U.S.C.
31136(e) and 31315 to grant exemptions
from the Federal Motor Carrier Safety
Regulations. FMCSA must publish a
notice of each exemption request in the
Federal Register (49 CFR 381.315(a)).
The Agency must provide the public an
opportunity to inspect the information
relevant to the application, including
any safety analyses that have been
conducted. The Agency must also

provide an opportunity for public
comment on the request.
The Agency reviews the safety
analyses and the public comments, and
determines whether granting the
exemption would likely achieve a level
of safety equivalent to, or greater than,
the level that would be achieved by the
current regulation (49 CFR 381.305).
The decision of the Agency must be
published in the Federal Register (49
CFR 381.315(b)) with the reason for the
grant or denial, and, if granted, the
specific person or class of persons
receiving the exemption, and the
regulatory provision or provisions from
which exemption is granted. The notice
must also specify the effective period of
the exemption (up to 5 years), and
explain the terms and conditions of the
exemption. The exemption may be
renewed (49 CFR 381.300(b)).
III. Request for Exemption
Daimler has applied for an exemption
for Christopher Veber from 49 CFR
383.23, which prescribes licensing
requirements for drivers operating
CMVs in interstate or intrastate
commerce. Mr. Veber is unable to obtain
a CDL in any of the U.S. States due to
his lack of residency in the United
States. A copy of the application is in
Docket No. FMCSA–2012–0032.
The exemption would allow Mr.
Veber to operate CMVs in interstate or
intrastate commerce to support Daimler
field tests designed to meet future
vehicle safety and environmental
requirements and to promote
technological advancements in vehicle
safety systems and emissions
reductions. Mr. Veber needs to drive
Daimler vehicles on public roads to
better understand ‘‘real world’’
environments in the U.S. market.
According to Daimler, Mr. Veber will
typically drive for no more than 6 hours
per day for 2 consecutive days, and that
10 percent of the test driving will be on
two-lane State highways, while 90
percent will be on Interstate highways.
The driving will consist of no more than
200 miles per day, for a total of 400
miles during a two-day period on a
quarterly basis. He will in all cases be
accompanied by a holder of a U.S. CDL
who is familiar with the routes to be
traveled.
Mr. Veber holds a valid German
commercial license, and as explained by
Daimler in its exemption request, the
requirements for that license ensure that
the same level of safety is met or
exceeded as if this driver had a U.S.
CDL. Furthermore, according to
Daimler, Mr. Veber is familiar with the
operation of CMVs worldwide. Daimler

requests that the exemption cover the
maximum allowable duration of 5 years.
IV. Method To Ensure an Equivalent or
Greater Level of Safety
FMCSA has previously determined
that the process for obtaining a German
commercial license is comparable to, or
as effective as, the requirements of part
383, and adequately assesses the
driver’s ability to operate CMVs in the
U.S. Since 2012, FMCSA has granted
Daimler drivers similar exemptions
[May 25, 2012 (77 FR 31422); July 22,
2014 (79 FR 42626); March 27, 2015 (80
FR 16511); October 5, 2015 (80 FR
60220); July 12, 2016 (81 FR 45217);
July 25, 2016 (81 FR 48496); August 17,
2017 (82 FR 39151)].

II. Background
On February 14, 2018, FMCSA
published a notice announcing receipt
of applications from 43 individuals
requesting an exemption from diabetes
requirement in 49 CFR 391.41(b)(3) and
requested comments from the public (83
FR 6674). The public comment period
ended on March 16, 2017, and no
comments were received.
FMCSA has evaluated the eligibility
of these applicants and determined that
granting the exemptions to these
individuals would achieve a level of
safety equivalent to or greater than the
level that would be achieved by
complying with the current regulation
49 CFR 391.41(b)(3).
The physical qualification standard
for drivers regarding diabetes found in
49 CFR 391.41(b)(3) states that a person
is physically qualified to drive a CMV
if that person has no established
medical history or clinical diagnosis of
diabetes mellitus currently requiring
insulin for control.
III. Discussion of Comments
FMCSA received no comments in this
proceeding.
IV. Basis for Exemption Determination
Under 49 U.S.C. 31136(e) and 31315,
FMCSA may grant an exemption from
the diabetes standard in 49 CFR
391.41(b)(3) if the exemption is likely to
achieve an equivalent or greater level of
safety than would be achieved without
the exemption. The exemption allows
the applicants to operate CMVs in
interstate commerce.
The Agency’s decision regarding these
exemption applications is based on the

program eligibility criteria and an
individualized assessment of
information submitted by each
applicant. The qualifications,
experience, and medical condition of
each applicant were stated and
discussed in detail in the February 14,
2018, Federal Register notice (83 FR
6674) and will not be repeated in this
notice.
These 43 applicants have had ITDM
over a range of 1 to 43 years. These
applicants report no severe
hypoglycemic reactions resulting in loss
of consciousness or seizure, requiring
the assistance of another person, or
resulting in impaired cognitive function
that occurred without warning
symptoms, in the past 12 months and no
recurrent (two or more) severe
hypoglycemic episodes in the past five
years. In each case, an endocrinologist
verified that the driver has
demonstrated a willingness to properly
monitor and manage his/her diabetes
mellitus, received education related to
diabetes management, and is on a stable
insulin regimen. These drivers report no
other disqualifying conditions,
including diabetes related
complications. Each meets the vision
requirement at 49 CFR 391.41(b)(10).
Consequently, FMCSA finds that in
each case exempting these applicants
from the diabetes requirement in 49 CFR
391.41(b)(3) is likely to achieve a level
of safety equal to that existing without
the exemption.
V. Conditions and Requirements
The terms and conditions of the
exemption are provided to the
applicants in the exemption document
and includes the following: (1) Each
driver must submit a quarterly
monitoring checklist completed by the
treating endocrinologist as well as an
annual checklist with a comprehensive
medical evaluation; (2) each driver must
report within two business days of
occurrence, all episodes of severe
hypoglycemia, significant
complications, or inability to manage
diabetes; also, any involvement in an
accident or any other adverse event in
a CMV or personal vehicle, whether or
not it is related to an episode of
hypoglycemia; (3) each driver must
provide a copy of the ophthalmologist’s
or optometrist’s report to the Medical
Examiner at the time of the annual
medical examination; and (4) each
driver must provide a copy of the
annual medical certification to the
employer for retention in the driver’s
qualification file, or keeping a copy in
his/her driver’s qualification file if he/
she is self-employed. The driver must
also have a copy of the exemption when

(49 CFR 381.315(a)). The Agency must provide the public an opportunity
to inspect the information relevant to the application, including any
safety analyses that have been conducted. The Agency must also provide
an opportunity for public comment on the request.
The Agency reviews the safety analyses and the public comments, and
determines whether granting the exemption would likely achieve a level
of safety equivalent to, or greater than, the level that would be
achieved by the current regulation (49 CFR 381.305). The decision of
the Agency must be published in the Federal Register (49 CFR
381.315(b)) with the reason for the grant or denial, and, if granted,
the specific person or class of persons receiving the exemption, and
the regulatory provision or provisions from which exemption is granted.
The notice must also specify the effective period of the exemption (up
to 5 years), and explain the terms and conditions of the exemption. The
exemption may be renewed (49 CFR 381.300(b)).
III. Request for Exemption
Daimler has applied for an exemption for Christopher Veber from 49
CFR 383.23, which prescribes licensing requirements for drivers
operating CMVs in interstate or intrastate commerce. Mr. Veber is
unable to obtain a CDL in any of the U.S. States due to his lack of
residency in the United States. A copy of the application is in Docket
No. FMCSA-2012-0032.
The exemption would allow Mr. Veber to operate CMVs in interstate
or intrastate commerce to support Daimler field tests designed to meet
future vehicle safety and environmental requirements and to promote
technological advancements in vehicle safety systems and emissions
reductions. Mr. Veber needs to drive Daimler vehicles on public roads
to better understand ``real world'' environments in the U.S. market.
According to Daimler, Mr. Veber will typically drive for no more than 6
hours per day for 2 consecutive days, and that 10 percent of the test
driving will be on two-lane State highways, while 90 percent will be on
Interstate highways. The driving will consist of no more than 200 miles
per day, for a total of 400 miles during a two-day period on a
quarterly basis. He will in all cases be accompanied by a holder of a
U.S. CDL who is familiar with the routes to be traveled.
Mr. Veber holds a valid German commercial license, and as explained
by Daimler in its exemption request, the requirements for that license
ensure that the same level of safety is met or exceeded as if this
driver had a U.S. CDL. Furthermore, according to Daimler, Mr. Veber is
familiar with the operation of CMVs worldwide. Daimler

requests that the exemption cover the maximum allowable duration of 5
years.
IV. Method To Ensure an Equivalent or Greater Level of Safety
FMCSA has previously determined that the process for obtaining a
German commercial license is comparable to, or as effective as, the
requirements of part 383, and adequately assesses the driver's ability
to operate CMVs in the U.S. Since 2012, FMCSA has granted Daimler
drivers similar exemptions [May 25, 2012 (77 FR 31422); July 22, 2014
(79 FR 42626); March 27, 2015 (80 FR 16511); October 5, 2015 (80 FR
60220); July 12, 2016 (81 FR 45217); July 25, 2016 (81 FR 48496);
August 17, 2017 (82 FR 39151)].
