with ATF, file an intent to import

Decision and Order
On February 16, 2017, the Assistant
Administrator, Diversion Control
Division, Drug Enforcement
Administration, issued an Order to
Show Cause to Bernard Wilberforce
Shelton, M.D. (hereinafter, Registrant),
which proposed the revocation of his
DEA Certificates of Registration Nos.
BS9770961 and FS6457407, as well as
the denial of any pending application to
renew these registrations or for any
other registration. GX 2, at 1. As
grounds for the proposed actions, the
Government alleged that Registrant’s
continued registration is ‘‘inconsistent
with the public interest’’ and that he is
without state authority to handle
controlled substances in the State of
Michigan, the State in which he holds
his registrations. Id. at 1–2 (citing 21
U.S.C. 824(a)(3) and (4), 823(f)).
With respect to the Agency’s
jurisdiction, the Show Cause Order
alleged that Registrant holds two
