SUPPLEMENTARY INFORMATION: I. Introduction The NRC is granting exemptions from paragraph B of section III, ‘‘Scope and Contents,’’ of appendix D, ‘‘Design Certification Rule for the AP1000,’’ to part 52 of title 10 of the Code of Federal Regulations (10 CFR) and issuing License Amendment Nos. 100 and 99 to COLs, NPF–91 and NPF–92, respectively, to the licensee. The exemptions are required by paragraph A.4 of section VIII, ‘‘Processes for Changes and Departures,’’ appendix D, to 10 CFR part 52 to allow the licensee to depart from Tier 1 information. With the requested amendment, the licensee proposes changes to the Updated Final Safety Analysis Report in the form of departures from the Plant-Specific Design Control Document (PS–DCD) Tier 2 information and involves changes to plant-specific Tier 1 information (and corresponding changes to COL Appendix C). Specifically, the amendment proposes changes to the protection and safety monitoring system including the reactor trip system and the engineered safety feature actuation system, the passive core cooling system, the steam generator blowdown system, and the spent fuel pool cooling system. In addition, revisions are proposed to COL Appendix A, Technical Specifications. Part of the justification for granting the exemptions was provided by the review of the amendments. Because the exemption is necessary in order to issue the requested license amendment, the NRC granted the exemptions and issued the amendments concurrently, rather than in sequence. This included issuing a combined safety evaluation containing the NRC staff’s review of both the exemption request and the license amendment. The exemptions met all applicable regulatory criteria set forth in 10 CFR 50.12, 10 CFR 52.7, and Section VIII.A.4 of appendix D to 10 CFR part 52. The license amendments were found to be acceptable as well. The combined safety evaluation is available in ADAMS under Accession No. ML17284A075. Identical exemption documents (except for referenced unit numbers and license numbers) were issued to the licensee for VEGP Units 3 and 4 (COLs NPF–91 and NPF–92).     Follow the procedures found at 45 CFR part 613.

Exemptions Promulgated for the System:
    In accordance with 5 U.S.C. 552a(k)(2), investigative material in 
this system of records compiled for law enforcement purposes is exempt 
from subsections (c)(3), (d), (e)(1), (e)(4)(G), (H) and (I), and (f) 
of 5 U.S.C. 552a, provided, however, that if any individual is denied 
any right, privilege, or benefit that he or she would otherwise be 
entitled to by federal law, or for which he or she would otherwise be 
eligible, as a result of the maintenance of these records, such 
material shall be provided to the individual, except to the extent that 
the disclosure of the material would reveal the identity of a source 
who furnished information to the government with an express promise 
that the identity of the source would be held in confidence.
