Final rule; correcting
amendments.
ACTION:
This document corrects errors
in the Code of Federal Regulations
relating to the Commission’s
jurisdictional separations rules. In a rule
published in the Federal Register on
June 2, 2017, the date ‘‘December 30,
2018’’ was inadvertently used, and is
now replaced by ‘‘December 31, 2018,’’
the date adopted in the Commission’s
underlying order.

Whitetip Shark as Threatened Under
the Endangered Species Act

In response to a petition by
Defenders of Wildlife, we, NMFS, are

issuing a final rule to list the oceanic
whitetip shark (Carcharinus
lonigmanus) as threatened under the
Endangered Species Act (ESA). We have
reviewed the status of the oceanic
whitetip shark, including efforts being
made to protect the species, and
considered public comments submitted
on the proposed listing rule as well as
new information received since
publication of the proposed rule. Based
on all of this information, we have
determined that the oceanic whitetip
shark warrants listing as a threatened
species. At this time, we conclude that
critical habitat is not determinable
because data sufficient to perform the
required analyses are lacking; however,
we solicit information on habitat
features and areas in U.S. waters that
may meet the definition of critical
habitat for the oceanic whitetip shark.

1, 2018.

SUPPLEMENTARY INFORMATION:
Background
On September 21, 2015, we received
a petition from Defenders of Wildlife to
list the oceanic whitetip shark
(Carcharhinus longimanus) as
threatened or endangered under the
ESA throughout its entire range, or
alternatively, to list two distinct
population segments (DPSs) of the
oceanic whitetip shark, as described in
the petition, as threatened or
endangered, and to designate critical
habitat. We found that the petitioned
action may be warranted for the species;
and, on January 12, 2016, we published
a positive 90-day finding for the oceanic
whitetip shark (81 FR 1376),
announcing that the petition presented
substantial scientific or commercial
information indicating the petitioned
action may be warranted range wide,
and explaining the basis for the finding.
We also announced the initiation of a
status review of the species, as required
by section 4(b)(3)(a) of the ESA, and
requested information to inform the
agency’s decision on whether the
species warranted listing as endangered
or threatened under the ESA. On
December 29, 2016, we published a
proposed rule to list the oceanic
whitetip shark as threatened (81 FR
96304). We requested public comments
