Take notice that on October 12, 2017,
pursuant to section 385.207 of the
Federal Energy Regulatory
Commission’s (Commission) Rules of
Practice and Procedure, 18
385.207(2017), Constitution Pipeline
Company, LLC (Constitution) filed a
Petition for Declaratory Order finding
that New York State Department of
Environmental Conservation failed to
act within a reasonable period of time
on Constitution’s Clean water Act
Section 401 application, and that such
failure to act constitutes a waiver of
Section 401 water quality certification
requirement for federal authorizations
related to the New York State portion of
Constitution’s pipeline project, all as
more fully explained in the petition.
Any person desiring to intervene or to
