SUPPLEMENTARY INFORMATION: The Department reviews Presidential permit applications under Executive Order (E.O.) 13337 and E.O. 14432. E.O. 13337 delegates to the Secretary of State the President’s authority to receive applications for permits for the construction, connection, operation, or maintenance of facilities for the exportation or importation of petroleum, petroleum products, coal, or other fuels (except for natural gas), at the borders of the United States, and to issue or deny such Presidential permits upon a national interest determination. On August 12, 2016, Borrego submitted an application to the Department. The application requests a new Presidential permit that would authorize the construction, connection, operation and maintenance of facilities at the United States-Mexico border (border facilities) for the export to Mexico of refined petroleum products (including gasoline, premium gasoline, ultra-low sulfur diesel [ULSD] and jet fuels). The petroleum products would be transported through the new pipeline between a terminal in Laredo, Texas, and the existing Nuevo Laredo Terminal in Tamaulipas, Mexico. The Draft EA and Preliminary FONSI were prepared consistent with the PO 00000 Frm 00098 Fmt 4703 Sfmt 4703 48309 National Environmental Policy Act (NEPA) of 1969 (42 U.S.C.
