operative delay. The Commission
believes that waiving the 30-day
operative delay is consistent with the
protection of investors and the public
interest as it will allow the Exchange to
clarify the conditions under which the
Secondary Source of data may be
elected and increase transparency of the
operation of the Exchange. Accordingly,
the Commission hereby waives the
operative delay and designates the
proposal operative upon filing.15
At any time within 60 days of the
filing of the proposed rule change, the
Commission summarily may
temporarily suspend such rule change if
it appears to the Commission that such
action is: (i) Necessary or appropriate in
the public interest; (ii) for the protection
of investors; or (iii) otherwise in
furtherance of the purposes of the Act.
If the Commission takes such action, the
Commission shall institute proceedings
to determine whether the proposed rule
should be approved or disapproved.

FMCSA announces its
decision to grant an exemption to
Daimler Trucks North America
(Daimler) for one of its commercial
motor vehicle (CMV) drivers. Daimler
requested a 5-year exemption from the
Federal requirement to hold a U.S.
commercial driver’s license (CDL) for
Mr. Philipp Helbing, a project engineer
for the Daimler Trucks and Bus
Division. Mr. Helbing holds a valid
German commercial license and wants
to test-drive Daimler vehicles on U.S.
roads to better understand product
requirements for these systems in ‘‘real
world’’ environments, and verify
results. Daimler believes the
requirements for a German commercial
license ensure that holders of the
license will likely achieve a level of
safety equal to or greater than that of
drivers who hold a U.S. State-issued
CDL.
SUMMARY:
Acting under the authority of and in
accordance with section 1(b) of
Executive Order 13224 of September 23,
2001, as amended by Executive Order
13268 of July 2, 2002, and Executive
Order 13284 of January 23, 2003, I
hereby determine that the person known
as of Hizbul Mujahideen, also known as
Hizb-ul-Mujahideen, also known as HM,
committed, or poses a significant risk of
committing, acts of terrorism that
threaten the security of U.S. nationals or
the national security, foreign policy, or
economy of the United States.
Consistent with the determination in
section 10 of Executive Order 13224 that
prior notice to persons determined to be
subject to the Order who might have a
constitutional presence in the United
States would render ineffectual the
blocking and other measures authorized
in the Order because of the ability to
transfer funds instantaneously, I
determine that no prior notice needs to
be provided to any person subject to this
determination who might have a
constitutional presence in the United
States, because to do so would render
ineffectual the measures authorized in
the Order.
This notice shall be published in the
Federal Register.

II. Legal Basis
FMCSA has authority under 49 U.S.C.
31136(e) and 31315 to grant exemptions
from the Federal Motor Carrier Safety
Regulations. FMCSA must publish a
notice of each exemption request in the
Federal Register (49 CFR 381.315(a)).
The Agency must provide the public an
opportunity to inspect the information
relevant to the application, including
any safety analyses that have been
conducted. The Agency must also
provide an opportunity for public
comment on the request.
The Agency reviews the safety
analyses and the public comments, and
determines whether granting the
exemption would likely achieve a level
of safety equivalent to, or greater than,
the level that would be achieved by the
current regulation (49 CFR 381.305).
The decision of the Agency must be
published in the Federal Register (49
CFR 381.315(b)) with the reason for the
grant or denial, and, if granted, the
specific person or class of persons
receiving the exemption, and the
regulatory provision or provisions from
which exemption is granted. The notice
must also specify the effective period of
the exemption (up to 5 years), and
explain the terms and conditions of the
exemption. The exemption may be
renewed (49 CFR 381.300(b)).
Request for Exemption
On behalf of Mr. Philipp Helbing,
Daimler has applied for a 5-year
exemption from 49 CFR 383.23, which
prescribes licensing requirements for
drivers operating CMVs in interstate or
