was originally scheduled to close on

II. Discussion
On July 3, 2017, the NRC solicited
comments on ‘‘Clarification on
Endorsement of Nuclear Energy Institute
Guidance in Designing Digital Upgrades
in Instrumentation and Control
Systems.’’ The purpose of the RIS is
clarify the endorsed NEI 01–01 guidance
regarding licensee upgrades to digital
instrumentation and control systems.

I
U.S. Tennessee Valley Authority
(TVA or Licensee) is the holder of
Operating License Nos. NPF–90; and
NPF–96; DPR–33; DPR–52; DPR–68;
DPR–77; and DPR–79; issued by the
U.S. Nuclear Regulatory Commission
(NRC or Commission) pursuant to part
50 of title 10 of the Code of Federal
Regulations (10 CFR). The licenses
authorize the operation of the Watts Bar
Nuclear Plant (WBN) Units 1 and 2,
Browns Ferry Nuclear Plant, Units 1, 2
and 3, and Sequoyah Nuclear Plant,
Units 1 and 2, in accordance with
conditions specified therein. These
facilities are located in Spring City,
Tennessee, Athens, Alabama, and
Soddy Daisy, Tennessee, respectively.
This Confirmatory Order (CO) is the
result of an agreement reached during

an alternative dispute resolution (ADR)
mediation session conducted on June 9,
2017.
II
On December 1, 2016, the U. S.
Nuclear Regulatory Commission (NRC)
completed a Problem Identification and
Resolution inspection at TVA’s Watts
Bar Nuclear Plant (WBN), Units 1 and
2 (Inspection Report 05000390/2016013,
05000391/2016013, ML17069A133).
The results of the inspection were
transmitted to TVA by letter dated
March 10, 2017, and included the
identification of one Apparent Violation
(AV) of a previously issued CO, (EA–
09–009,203, dated December 22, 2009,
ML093510993). The AV involved the
following:
Confirmatory Order Modifying
License, (EA–09–009,203) dated
December 22, 2009, (ML093510993)
states, in part, that by no later than
ninety (90) calendar days after the
issuance of this Confirmatory Order,
TVA shall implement a process to
review proposed licensee adverse
employment actions at TVA’s nuclear
plant sites before actions are taken to
determine whether the proposed action
comports with employee protection
regulations, and whether the proposed
actions could negatively impact the
Safety Conscious Work Environment
(SCWE). Such a process should consider
actions to mitigate a potential chilling
effect if the employment action, despite
its legitimacy, could be perceived as
retaliatory by the workforce.
Additionally, by no later than one
hundred twenty (120) calendar days
after the issuance of the Confirmatory
Order, TVA shall implement a process
to review proposed significant adverse
employment actions by contractors
performing services at TVA’s nuclear
plant sites before the actions are taken
to determine whether the proposed
action comports with employee
protection regulations, and whether the
proposed action could negatively
impact the SCWE. Such a process will
likewise consider actions to mitigate a
potential chilling effect if the
employment action, despite its
legitimacy, could be perceived as
retaliatory by the workforce.
TVA implements the above process
through procedure NPG–SPP–11.10,
Adverse Employment Action. NPG–
SPP–11.10, Section 3.2.2, entitled
‘‘Review Process—Personnel Actions
Impacting TVA Employees,’’ paragraph
