Kelly, D.P.M.; Decision and Order On July 10, 2015, the Deputy Assistant Administrator, Office of Diversion Control, Drug Enforcement Administration, issued an Order to Show Cause to Peter F. Kelly, D.P.M. (Respondent), of Roanoke, Virginia. ALJ Ex. 1, at 1. The Show Cause Order proposed the revocation of Respondent’s Certificate of Registration No. BK0639279, the denial of any application to renew or modify his registration, and the denial of any other application for a DEA registration, on the ground that he has committed acts which render his registration ‘‘inconsistent with the public interest.’’ Id. (citing 21 U.S.C. 824(a)(4), 823(f)). As to the jurisdictional basis for the proceeding, the Show Cause Order alleged that Respondent is registered ‘‘as a practitioner in [s]chedules II–V,’’ under the above registration number, at the address of 4106 Electric Road, Roanoke, Virginia. Id. The Show Cause Order alleged that Respondent’s registration does not expire until December 31, 2017. Id. As to the substantive grounds for the proceeding, the Show Cause Order alleged that in June 2000, Respondent was indicted in the Circuit Court for Roanoke County, Virginia, on four felony counts of unlawful possession of E:\FR\FM\23JNN1.SGM 23JNN1
