behavior changes, and is not expected to
result in the injury or death of any
marine mammal. As such, the proposed
project is not likely to adversely impact
the availability of any marine mammal
species or stocks that may otherwise be
used for subsistence purposes.

Endangered Species Act (ESA)
AGENCY:
Threatened or endangered marine
mammal species with confirmed
occurrence in the project area include
the Western North Pacific DPS and
Mexico DPS of humpback whale, and
the Western DPS Steller sea lion. The
project area occurs within critical
habitat for three major Steller sea lion
haul-outs and one rookery. The three
haul-outs (Old Man Rocks, Unalaska/
Cape Sedanka, and Akutan/Reef-Lava)
are located between approximately 15
and 19 nautical miles from the project
area. The closest rookery is Akutan/
Cape Morgan, which is about 19
nautical miles from the project area.
The NMFS Alaska Regional Office
Protected Resources Division issued a
Biological Opinion on April 19, 2017,
under Section 7 of the ESA, on the
issuance of an IHA to the COU under
section 101(a)(5)(D) of the MMPA by the
NMFS Permits and Conservation
Division. The Biological Opinion
concluded that the action is not likely
to jeopardize the continued existence of
Western DPS Steller sea lions or the
Mexico DPSs of humpback whales, and
is not likely to destroy or adversely
modify western DPS Steller sea lion
critical habitat.
National Environmental Policy Act
(NEPA)

NMFS prepared an Environmental
Assessment (EA) analyzing the potential
impacts to marine mammals from the
proposed action and subsequently
signed a Finding of No Significant
Impact (FONSI). A copy of the EA and
Finding of No Significant Impact

ADDRESSES).
