k. Description of Request: The
licensee requests that the Commission
delete Article 404 from the project
license. Article 404 requires the licensee
to monitor fish mortality and develop a
plan to reduce mortality and
compensate West Virginia and Ohio
Departments of Natural Resources for
the remaining fish mortality. The
licensee cited the Court of Appeals in
City of New Martinsville v. FERC, 103 F.
3d 567 (D.C. Cir. 1996), and stated that
since the court case the Commission
policy regarding such compensation has
changed. The licensee also cited several
Commission decisions that have
occurred since the court case as support
for their request.
