Notice Pursuant to the National
Cooperative Research and Production
Act of 1993—Integrated Photonics
Institute for Manufacturing Innovation
Operating Under the Name of the
American Institute for Manufacturing
Integrated Photonics
Notice is hereby given that, on March
22, 2017, pursuant to Section 6(a) of the
National Cooperative Research and
Production Act of 1993, 15 U.S.C. 4301
et seq. (‘‘the Act’’), the Integrated
Photonics Institute for Manufacturing
Innovation operating under the name of
the American Institute for
Manufacturing Integrated Photonics
(‘‘AIM Photonics’’) has filed written
notifications simultaneously with the
Attorney General and the Federal Trade
Commission disclosing changes in its
membership. The notifications were
filed for the purpose of extending the
Act’s provisions limiting the recovery of
antitrust plaintiffs to actual damages
under specified circumstances.
Specifically, International Business
Machines, Yorktown Heights, NY;
Mentor Graphics Corporation,
Wilsonville, OR; Keysight Technologies,
Inc., Santa Rosa, CA; Analog Photonics,
LLC, Boston, MA; Coventor, Inc., Cary,
NC; Trustees of Boston University,
Boston, MA; Georgia Tech Research
Corporation, Atlanta, GA; The
University of Tulsa, Tulsa, OK;
University of Massachusetts Lowell,
Lowell, MA; University of Delaware,
Newark, DE; PricewaterhouseCoopers,
LLC, Rochester, NY; and ESL Federal
Credit Union, Rochester, NY have been
added as parties to this venture.
No other changes have been made in
either the membership or planned
activity of the group research project.
Membership in this group research
project remains open, and AIM
Photonics intends to file additional
written notifications disclosing all
changes in membership.
On June 16, 2016, AIM Photonics
filed its original notification pursuant to
Section 6(a) of the Act. The Department
of Justice published a notice in the
Federal Register pursuant to Section
6(b) of the Act on July 25, 2016 (81 FR
48450).
The last notification was filed with
the Department on December 23, 2016.

ACTION: Notice of proposed exemption.
AGENCY:
This document contains
notices of pendency before the
Department of Labor (the Department) of
proposed exemption from certain of the
prohibited transaction restrictions of the
Employee Retirement Income Security
Act of 1974 (ERISA or the Act) and/or
the Internal Revenue Code of 1986 (the
Code). This notice includes the
following proposed exemption: D–
11845, Rosetree & Company 401(k) Plan
and Trust.
DATES: All interested persons are invited
to submit written comments or requests
for a hearing on the pending exemption
within May 31, 2017.
ADDRESSES: Comments and requests for
a hearing should state: (1) The name,
address, and telephone number of the
person making the comment or request,
and (2) the nature of the person’s
interest in the exemption and the
manner in which the person would be
adversely affected by the exemption. A
request for a hearing must also state the
issues to be addressed and include a
general description of the evidence to be
presented at the hearing.

SUPPLEMENTARY INFORMATION:
The proposed exemption was
requested in an application filed
pursuant to section 408(a) of the Act
and/or section 4975(c)(2) of the Code,
and in accordance with procedures set
forth in 29 CFR part 2570, subpart B (76
FR 66637, 66644, October 27, 2011).1
Effective December 31, 1978, section
102 of Reorganization Plan No. 4 of
1978, 5 U.S.C. App. 1 (1996), transferred
the authority of the Secretary of the
Treasury to issue exemptions of the type
requested to the Secretary of Labor.
Therefore, this notice of proposed
exemption is issued solely by the
Department.
The application contains
representations with regard to the
proposed exemption which are
summarized below. Interested persons
are referred to the applications on file
with the Department for a complete
statement of the facts and
representations.

PROPOSED EXEMPTION
Based on the facts and representations
set forth in the application, the
Department is considering granting an
exemption under section 4975(c)(2) of
the Code and in accordance with the
procedures set forth in 29 CFR part
2570, subpart B (76 FR 66637, 66644,
October 27, 2011).
SECTION I. COVERED TRANSACTION
If the proposed exemption is granted,
the sanctions resulting from the
application of section 4975(c)(1)(B) of
the Code, shall not apply to the
proposed guarantee (the Guarantee) by
