Qualifying Conduit Hydropower Facility Description: The proposed project would consist of: (1) An approximately 10-foot by 10-foot shed containing two 800-kW turbine/ generating units with a total installed capacity of 1.6 kW; (2) a short penstock to the turbine that wyes off a 4-inchdiameter water supply pipeline; (3) a 20-foot-long, open channel tailrace discharging water to Mill Brook; and (4) appurtenant facilities. The proposed project would have an estimated annual generating capacity of 13,000 kilowatthours. A qualifying conduit hydropower facility is one that is determined or deemed to meet all of the criteria shown in the table below. Preliminary Determination: The proposed addition of the hydroelectric project along the upgraded irrigation and domestic water supply pipeline will not alter its primary purpose. Yoder Farm has stated that the primary purpose of the pipeline upgrade is to improve the efficiency of the existing pipe, and that it will proceed with the pipeline upgrade regardless of the ability to generate electricity. Yoder Farm has also indicated that the generator is subordinate to the agricultural demands of the conduit, and will operate only in instances where excess water must be released. Therefore, based upon the above information and criteria, Commission staff preliminarily determines that the proposal satisfies the requirements for a qualifying conduit hydropower facility, which is not required to be licensed or exempted from licensing. Comments and Motions To Intervene: Deadline for filing comments contesting whether the facility meets the qualifying criteria is 45 days from the issuance date of this notice. Deadline for filing motions to intervene is 30 days from the issuance date of this notice. If a Notice of Schedule for Environmental Review is issued, it will indicate, among other milestones, the anticipated date for the Commission staff’s issuance of the final environmental impact statement (FEIS) or EA for this proposal.
