Notice is hereby given that, on
December 21, 2016, pursuant to Section
6(a) of the National Cooperative
Research and Production Act of 1993,
15 U.S.C. 4301 et seq. (‘‘the Act’’), R
Consortium, Inc. (‘‘R Consortium’’) has
filed written notifications
simultaneously with the Attorney
General and the Federal Trade
Commission disclosing changes in its

filed for the purpose of extending the
Act’s provisions limiting the recovery of
antitrust plaintiffs to actual damages
under specified circumstances.
Specifically, Moore Foundation, Palo
Alto, CA; and Datacamp, Cambridge,
MA, have been added as parties to this
venture.
No other changes have been made in
either the membership or planned
activity of the group research project.
Membership in this group research
project remains open, and R Consortium
intends to file additional written
notifications disclosing all changes in
membership.
On September 15, 2015, R Consortium
filed its original notification pursuant to
Section 6(a) of the Act. The Department
of Justice published a notice in the
Federal Register pursuant to Section
6(b) of the Act on October 2, 2015 (80
FR 59815).
The last notification was filed with
the Department on October 7, 2016. A
notice was published in the Federal
Register pursuant to Section 6(b) of the
Act on November 3, 2016 (81 FR 76629).

Notice is hereby given pursuant to the
Antitrust Procedures and Penalties Act,
15 U.S.C. 16(b)–(h), that a proposed
Final Judgment, Stipulation, and
Competitive Impact Statement have
been filed with the United States
District Court for the District of
Columbia in United States of America v.
Duke Energy Corporation, Civil Action
No. 1:17–cv–00116. On January 18,
2017, the United States filed a
Complaint alleging that Duke Energy
Corporation violated Section 7A of the
Clayton Act, 15 U.S.C. 18a, by acquiring
the Osprey Energy Center from Calpine
Corporation before filing the required
notification form and observing the
required waiting period. The proposed
Final Judgment, filed at the same time
as the Complaint, requires Duke Energy
Corporation to pay a civil penalty of
$600,000.
