Operations, L.L.C. (Nogales Operations)

Finding that Nogales Transmission is a
passive entity and therefore not a
‘‘public utility’’ under the Federal
Power Act, or an ‘‘electric utility
company’’ under the Public Utility
Holding Company Act of 2005; (2)
granting Nogales Operations negotiated
rate authority; (3) approving Nogales
Operations’ capacity allocation
methodology; and (4) granting certain
waivers of Commission regulations, all
as more fully explained in the petition.
