This constitutes notice, in accordance
with 18 CFR 385.2201(b), of the receipt
of prohibited and exempt off-the-record

Order No. 607 (64 FR 51222,
September 22, 1999) requires
Commission decisional employees, who
make or receive a prohibited or exempt
off-the-record communication relevant
to the merits of a contested proceeding,
to deliver to the Secretary of the
Commission, a copy of the
communication, if written, or a
summary of the substance of any oral
communication.

associated with, but not a part of, the

Unless the Commission determines that

ACTION: Notice of proposed consent
decree; request for public comment.
AGENCY:
In accordance with section
113(g) of the Clean Air Act, as amended
(‘‘CAA’’ or the ‘‘Act’’), notice is hereby
given of a proposed consent decree in
Sierra Club v. McCarthy, Civil Action
No. 1:16–cv–235 (D. D.C.). On February
12, 2016, the Sierra Club filed a
complaint in the United States District
Court for the District of Columbia,
alleging that Gina McCarthy, in her
official capacity as Administrator of the
United States Environmental Protection
Agency (‘‘EPA’’), failed to perform a
non-discretionary duty to grant or deny
within 60 days a petition submitted by
Sierra Club on September 29, 2015
requesting that EPA object to a CAA
Title V permit issued by the Tennessee
Department of Environment and
Conservation (‘‘TDEC’’) for the
Tennessee Valley Authority’s (‘‘TVA’’)
Bull Run Fossil Plant, located in
Clinton, Tennessee. The proposed
consent decree would establish a
deadline for EPA to take such action.
