‘‘Setting Customer Service Standards,’’
direct Federal agencies to provide
service to the public that matches or
exceeds the best service available in the
private sector (58 FR 48257, Sept. 11,
1993). In order to work continuously to
ensure that our programs are effective
and meet our customers’ needs, MARAD
seeks to obtain OMB approval of a
previously approved generic clearance
to collect qualitative feedback from our
customers on our service delivery. By
qualitative feedback we mean
information that provides useful
insights on perceptions and opinions,
but are not statistical surveys that yield
quantitative results that can be
generalized to the population of study.
This feedback will provide insights into
customer or stakeholder perceptions,
experiences and expectations, provide
an early warning of issues with service,
or focus attention on areas where
communication, training or changes in
operations might improve delivery of
products or services. These collections
will allow for ongoing, collaborative and
actionable communications between the
Agency and its customers and

stakeholders. It will also allow feedback
to contribute directly to the
improvement of program management.
The solicitation of feedback will target
areas such as: Timeliness,
appropriateness, accuracy of
information, courtesy, efficiency of
service delivery, and resolution of
issues with service delivery. Responses
will be assessed to plan and inform
efforts to improve or maintain the
quality of service offered to the public.
If this information is not collected, vital
feedback from customers and
stakeholders on the Agency’s services
will be unavailable.
The Agency will only submit a
collection for approval under this
generic clearance if it meets the
following conditions:
• The collections are voluntary;
• The collections are low-burden for
respondents (based on considerations of
total burden hours, total number of
respondents, or burden-hours per
respondent) and are low-cost for both
the respondents and the Federal
Government;
• The collections are
noncontroversial and do not raise issues
of concern to other Federal agencies;
• Any collection is targeted to the
solicitation of opinions from
respondents who have experience with
the program or may have experience
with the program in the near future;
• Personally identifiable information
(PII) is collected only to the extent
necessary and is not retained;
• Information gathered is intended to
be used only internally for general
service improvement and program
management purposes and is not
intended for release outside of the
agency (if released, the agency must
indicate the qualitative nature of the
information);
• Information gathered will not be
used for the purpose of substantially
informing influential policy decisions;
and
• Information gathered will yield
qualitative information; the collections
will not be designed or expected to
yield statistically reliable results or used
as though the results are generalizable to
the population of study.
Feedback collected under this generic
clearance provides useful information,
but it does not yield data that can be
generalized to the overall population.
This type of generic clearance for
qualitative information will not be used
for quantitative information collections
that are designed to yield reliably
actionable results, such as monitoring
trends over time or documenting
program performance. Such data uses
require more rigorous designs that

notice that, pursuant to the authority
contained in the USA PATRIOT Act, the
Director of FinCEN found on May 27,
2016 that reasonable grounds exist for
concluding that the Democratic People’s
Republic of Korea (‘‘DPRK’’ or ‘‘North
Korea’’) is a jurisdiction of primary
money laundering concern.

I. Background
A. Statutory Provisions
On October 26, 2001, the President
signed into law the Uniting and
Strengthening America by Providing
Appropriate Tools Required to Intercept
and Obstruct Terrorism Act of 2001 (the
‘‘USA PATRIOT Act’’), Public Law 107–
56. Title III of the USA PATRIOT Act
amends the anti-money laundering
provisions of the Bank Secrecy Act
(‘‘BSA’’), codified at 12 U.S.C. 1829b, 12
U.S.C 1951–1959, and 31 U.S.C. 5311–
5314 and 5316–5332, to promote
prevention, detection, and prosecution
of international money laundering and
the financing of terrorism. Regulations
implementing the BSA appear at 31 CFR
Chapter X.
Section 311 of the USA PATRIOT Act
(‘‘Section 311’’) added 31 U.S.C. 5318A
to the BSA, granting the Secretary of the
Treasury (the ‘‘Secretary’’) the authority,
upon finding that reasonable grounds
exist for concluding that a foreign
jurisdiction, institution, class of
transactions, or type of account is of
‘‘primary money laundering concern,’’
to require domestic financial
institutions and financial agencies to
take certain ‘‘special measures’’ against
the primary money laundering concern.
Section 311 identifies factors for the
Secretary to consider and requires
Federal agencies to consult before the
Secretary may conclude that a
jurisdiction, institution, class of
transaction, or type of account is of
primary money laundering concern. The
statute also provides similar procedures,
i.e., factors and consultation
requirements, for selecting the specific
special measures to be imposed against

the primary money laundering concern.
For purposes of the finding contained in
this notice, the Secretary has delegated
his authority under Section 311 to the
Director of FinCEN.1
Taken as a whole, Section 311
provides the Secretary with a range of
options that can be adapted to target
specific money laundering and terrorist
financing concerns most effectively.
Through the imposition of various
special measures, the Secretary can gain
more information about the
jurisdictions, institutions, transactions,
or accounts of concern; can more
effectively monitor the respective
jurisdictions, institutions, transactions,
or accounts; or can prohibit U.S.
financial institutions from involvement
with jurisdictions, institutions,
transactions, or accounts that pose a
money laundering concern.
Before making a finding that
reasonable grounds exist for concluding
that a jurisdiction is of primary money
laundering concern, the Secretary is
required to consult with both the
Secretary of State and the Attorney
General. The Secretary is also required
by Section 311, as amended,2 to
consider ‘‘such information as the
Secretary determines to be relevant,
including the following potentially
relevant factors,’’ which extend the
Secretary’s consideration beyond
traditional money laundering concerns
to issues involving, inter alia, terrorist
financing and the proliferation of
weapons of mass destruction (‘‘WMD’’)
or missiles:
• Evidence that organized criminal
groups, international terrorists, or
entities involved in the proliferation of
WMD or missiles, have transacted
business in that jurisdiction;
• The extent to which that
jurisdiction or financial institutions
operating in that jurisdiction offer bank
secrecy or special regulatory advantages
to nonresidents or nondomiciliaries of
that jurisdiction;
• The substance and quality of
administration of the bank supervisory
and counter- money laundering laws of
that jurisdiction;
• The relationship between the
volume of financial transactions
occurring in that jurisdiction and the
size of the economy of the jurisdiction;
• The extent to which that
jurisdiction is characterized as an
offshore banking or secrecy haven by
