Consent Decree Under the Clean Air
Act
DEPARTMENT OF JUSTICE
On May 4, 2016, the Department of
Justice lodged a proposed Consent
Decree with the United States District
Court for the District of New Jersey in
the lawsuit entitled United States v.
Parkway Iron and Metal Co., Inc., Civil
Action No. 2:16–cv–02515.
The United States filed this lawsuit
under the Clean Air Act. The United
States’ complaint seeks injunctive relief
and civil penalties for violations of the
Clean Air Act provisions governing
emission of ozone depleting substances
at the defendant’s scrap metal recycling
facility in Clifton, New Jersey. The
