Abstract: The purpose of this study is
to examine how state agencies, school
districts, and juvenile justice and child
welfare facilities implement education
and transition programs for youth who
are neglected or delinquent (N or D)
under the Elementary and Secondary
Education Act (ESEA), as amended by
the Every Student Succeeds Act (ESSA),
Title I, Part D. The information will be
used by ED to produce and disseminate
a report detailing how state agencies,
school districts, and juvenile justice and
child welfare facilities implement
education and transition programs for
youth who are neglected or delinquent
(N or D).

Authorization for Continued Project
Operation
On April 28, 2014 Turlock Irrigation
District and Modesto Irrigation District,
licensees for the Don Pedro
Hydroelectric Project, filed an
Application for a New License pursuant
to the Federal Power Act (FPA) and the
Commission’s regulations thereunder.
The Don Pedro Hydroelectric Project
facilities are located on the Tuolumne
River in Tuolumne County, California.
The license for Project No. 2299 was
issued for a period ending April 30,
2016. Section 15(a)(1) of the FPA, 16
U.S.C. 808(a)(1), requires the
Commission, at the expiration of a
license term, to issue from year-to-year
an annual license to the then licensee
under the terms and conditions of the
prior license until a new license is
issued, or the project is otherwise
disposed of as provided in section 15 or
any other applicable section of the FPA.
If the project’s prior license waived the
applicability of section 15 of the FPA,
then, based on section 9(b) of the
Administrative Procedure Act, 5 U.S.C.
558(c), and as set forth at 18 CFR
16.21(a), if the licensee of such project
has filed an application for a subsequent
license, the licensee may continue to
operate the project in accordance with
the terms and conditions of the license
after the minor or minor part license
expires, until the Commission acts on
its application. If the licensee of such a
project has not filed an application for
a subsequent license, then it may be
required, pursuant to 18 CFR 16.21(b),
to continue project operations until the
Commission issues someone else a
license for the project or otherwise
orders disposition of the project.
If the project is subject to section 15
of the FPA, notice is hereby given that
an annual license for Project No. 2299
is issued to the licensee for a period
effective May 1, 2016 through April 30,
2017 or until the issuance of a new
license for the project or other
disposition under the FPA, whichever
comes first. If issuance of a new license
(or other disposition) does not take
place on or before April 30, 2017, notice
is hereby given that, pursuant to 18 CFR
16.18(c), an annual license under
section 15(a)(1) of the FPA is renewed
automatically without further order or

Commission orders otherwise.
If the project is not subject to section
15 of the FPA, notice is hereby given
that the licensee, Turlock Irrigation

Supplemental Notice of Technical
Conference
As announced in the Notice of
Technical Conference issued on April
15, 2016 in the above-captioned
proceeding, a technical conference will
be held in this proceeding on Monday,
May 9, 2016, beginning at 10:00 a.m.
and ending at approximately 3:30 p.m.,
at the Federal Energy Regulatory
Commission, 888 First Street, NE.,
Washington, DC 20426. The purpose of
the technical conference is to examine
the issues raised in the protests and
comments regarding the February 19,
2016 filing made by Algonquin Gas
Transmission, LLC (Algonquin). In that
filing, Algonquin proposed to exempt
from the capacity release bidding
requirements certain types of capacity
releases of firm transportation by
electric distribution companies that are
participating in state-regulated electric
reliability programs.1 Issues to be
examined at the technical conference
include concerns raised regarding the
basis and need for the waiver.
The agenda for this technical
conference is attached. Due to the
number of parties requesting to make
presentations, each presentation will be
limited to fifteen minutes to provide
sufficient time for discussion. We have
allotted time between each presentation
for questions and comments from staff,
panelists, and the audience. Parties may
file in this docket longer presentations
or other materials prior to the technical
