Take notice that on April 25, 2016,
pursuant to Rule 207 of the Federal
Energy Regulatory Commission’s
(Commission) Rules of Practice and
Procedure,1 SunE B9 Holdings, LLC
(SunE), filed a petition for a declaratory
order requesting that the Commission
provide a limited waiver of the filing
requirements applicable to small power
production facilities set forth in Section
292.203(a)(3) of the Commission’s
regulations (QF Filing Requirements).2
SunE request waiver of QF filing
requirements for the time-period
beginning when various qualifying
small power production facilities (QFs)
owned by SunE, were placed into
operation during December 2010 and
ending on May 27, 2015, when SunE
filed QF self-certifications with respect
to such facilities, all as more fully
explained in the petition.
Any person desiring to intervene or to
protest this filing must file in
accordance with Rules 211 and 214 of
the Commission’s Rules of Practice and
Procedure (18 CFR 385.211 and
385.214). Protests will be considered by
the Commission in determining the
appropriate action to be taken, but will
