Foreign-Trade Zone 229—Charleston,
West Virginia; Application for
Reorganization/Expansion Under
Alternative Site Framework
An application has been submitted to
the Foreign-Trade Zones (FTZ) Board by
the West Virginia Economic
Development Authority, grantee of FTZ
229, requesting authority to reorganize

and expand the zone under the
alternative site framework (ASF)
adopted by the FTZ Board (15 CFR Sec.
400.2(c)). The ASF is an option for
grantees for the establishment or
reorganization of zones and can permit
significantly greater flexibility in the
designation of new subzones or ‘‘usagedriven’’ FTZ sites for operators/users
located within a grantee’s ‘‘service area’’
in the context of the FTZ Board’s
standard 2,000-acre activation limit for
a zone. The application was submitted
pursuant to the Foreign-Trade Zones
Act, as amended (19 U.S.C. 81a–81u),
and the regulations of the Board (15 CFR
part 400). It was formally docketed on
April 22, 2016.
FTZ 229 was approved by the FTZ
Board on February 13, 1998 (Board
Order 954, 63 FR 9177, February 24,
1998). The current zone includes the
following site: Site 1 (24 acres)—
Charleston Ordnance Center, 3100
MacCorkle Avenue SW., South
Charleston.
The grantee’s proposed service area
under the ASF would be the Counties of
Boone, Cabell, Calhoun, Clay, Fayette,
Jackson, Kanawha, Lincoln, Logan,
Mason, Mingo, Putnam, Raleigh, Roane,
Wayne, Wirt, Wood and Wyoming, as
described in the application. If
approved, the grantee would be able to
serve sites throughout the service area
based on companies’ needs for FTZ
designation. The application indicates
that the proposed service area is within
and adjacent to the Charleston Customs
and Border Protection port of entry.
The applicant is requesting authority
to reorganize its existing zone to include
existing Site 1 as a ‘‘magnet’’ site. The
applicant is also requesting approval of
the following ‘‘magnet’’ site: Proposed
Site 2 (78 acres)—Heartland Intermodal
Gateway, 401 Heartland Drive, Prichard,
West Virginia. The ASF allows for the
possible exemption of one magnet site
from the ‘‘sunset’’ time limits that
generally apply to sites under the ASF,
and the applicant proposes that Site 2
be so exempted. The application would
have no impact on FTZ 229’s previously
authorized subzones.
In accordance with the FTZ Board’s
regulations, Kathleen Boyce of the FTZ
Staff is designated examiner to evaluate
and analyze the facts and information
presented in the application and case
record and to report findings and
recommendations to the FTZ Board.
Public comment is invited from

Secretary at the address below. The

Notifications
This notice serves as a final reminder
to importers of their responsibility
under 19 CFR 351.402(f)(2) to file a
certificate regarding the reimbursement
of antidumping duties prior to
liquidation of the relevant entries
during this review period. Failure to
comply with this requirement could
result in the Department’s presumption
that reimbursement of the antidumping
duties occurred and the subsequent
assessment of doubled antidumping
duties.
This notice also serves as a final
reminder to parties subject to
administrative protective order (‘‘APO’’)
of their responsibility concerning the
return or destruction of proprietary
information disclosed under APO in
accordance with 19 CFR 351.305(a)(3),
which continues to govern business
proprietary information in this segment
of the proceeding. Timely written
notification of the return or destruction
of APO materials, or conversion to
judicial protective order, is hereby
requested. Failure to comply with the
regulations and terms of an APO is a
violation which is subject to sanction.
This notice is issued and published in
accordance with sections 751(a)(1) and
777(i)(1) of the Tariff Act of 1930, as
amended, and 19 CFR 351.213(d)(4).
