constitute a Fair Use application,
participants are requested not to include
copyrighted materials in their
submission.
If a person other than the licensee
requests a hearing, that person shall set
forth with particularity the manner in
which his or her interest is adversely
affected by this order and shall address
the criteria set forth in 10 CFR 2.309(d)
and (f).
In the absence of any request for
hearing or of written approval of an
extension of time in which to request a
hearing, the provisions specified in
Section IV above shall be final 20 days
from the date of this order without
further order or proceedings. If an
extension of time for requesting a
hearing has been approved, the
provisions specified in Section IV shall
be final when the extension expires if a
hearing request has not been received.

I. Introduction
On November 16, 2015, NYSE Arca,
Inc. (‘‘Exchange’’ or ‘‘NYSE Arca’’) filed
with the Securities and Exchange
Commission (‘‘Commission’’), pursuant
to Section 19(b)(1) of the Securities
Exchange Act of 1934 (‘‘Act’’) 1 and Rule
19b–4 thereunder,2 a proposed rule
change to list and trade shares
(‘‘Shares’’) of the Market Vectors
Dynamic Put Write ETF (the ‘‘Fund’’)
under NYSE Arca Equities Rule 8.600.
The proposed rule change was
published for comment in the Federal
Register on December 4, 2015.3 On
December 11, 2015, the Exchange filed
Amendment No. 1 to the proposed rule
change.4 The Commission received no
