White Pine Hydro operates the project in a run-of-river mode, in accordance with the 1997 Saco River Instream Flow Agreement, which provides that outflow approximate inflow from the upstream Bonny Eagle Project No. 2529 and act to minimize impoundment level fluctuations. White Pine Hydro also operates the project with a minimum outflow of 768 cfs, or inflow, whichever is less, in accordance with the project’s current water quality certificate. On December 3, 2015, the Commission issued an order denying a complaint filed by Sage Grouse Energy Project, LLC (Sage Grouse) against PacifiCorp under Rule 206(a) of the Commission’s Rules of Practice and Procedure.1 On December 16, 2015, Sage Grouse filed a motion for extension of time and waiver, asking the Commission to grant a 30-day extension of time for Sage Grouse to determine whether to file a request for rehearing of the December 3 Order. Pursuant to section 313(a) of the Federal Power Act,2 an aggrieved party must file an application for rehearing within thirty days after the issuance of the Commission’s order.
