k. Description of Request: By orders
issued November 17, 2006 and
September 8, 2008, the Commission
approved a proposed land exchange
involving specific lands within the
project boundary and required
Consolidated Water Power Company
(licensee) to fulfill certain conditions
related to the land exchange, such as
measures to provide for specific public
benefits (i.e., increased public
recreational and access opportunities
and a 100-foot-wide, approximately
3,000 linear foot shoreline buffer). In its
amendment application, the licensee
proposes changes to some of these
conditions, including, among other
things: (1) Specific modifications and
additions to various required recreation
and public access improvements, (2) a
shoreline buffer plan that would allow
additional development within the
buffer, including several multi-slip boat
docks and pedestrian paths, and (3) a
reduction in the width of the 100-footwide buffer to 50 feet wide for 300 feet
to accommodate existing restaurant
improvements.
