environmental risks (43 CFR 46.215).
Thus, prior to applying the categorical
exclusion when considering adding a
species as injurious under the Act, the
Service will review all of the
extraordinary circumstances in the
Department’s NEPA regulations. If any
extraordinary circumstance does apply,
the Service will conduct additional
NEPA analysis and prepare an EA or
EIS.
The categorical exclusion does not
cover all Service activities related to
injurious species. For example, the
categorical exclusion does not cover
control actions (such as constructing
barriers) or eradication actions (such as
applying pesticides). Any such injurious
species management measures
conducted by the Service will undergo
appropriate NEPA analysis and
documentation prior to implementation
of the action. The categorical exclusion
also does not cover the issuance of
permits (available for individual
specimens imported or transported for
zoological, educational, medical, or
scientific use), which is already covered
under an existing categorical exclusion
(516 DM 8.5 C(1)). The categorical
exclusion also does not cover the
removal of species from the injurious
wildlife lists under the Act.
