k. Description of Request: The
licensee requests that the minimum
flow requirements of article 105 of the
license for the Tule Project be revised to
reflect the requirements of the
conditions submitted by the U.S. Forest
Service (FS) pursuant to its mandatory
conditioning authority under section
4(e) of the Federal Power Act. Article
105 requires the licensee to release from
Tule Diversion Dam a minimum
‘‘target’’ flow of 4 cubic feet per second
(cfs) in dry water years and a minimum
‘‘target’’ flow of 2 cfs from Doyle
Springs Diversion Dam where the
‘‘target’’ flow is defined as the daily
average flow at each dam and an
instantaneous flow of not less than 10
percent of the daily average flow.
However, the FS’s condition 5 filed with
the Commission on October 31, 1989
and November 26, 1991, requires the
licensee to release from Tule Diversion
Dam a minimum ‘‘target’’ flow of 4 cfs
in dry water years and a minimum
‘‘target’’ flow of 2 cfs from Doyle
Springs Diversion Dam, or the natural
instream flow, whichever is less. The
licensee requests that article 105 be
revised to make it clear that the
minimum flow requirements are
dependent on and subject to the natural
instream flow of the Tule River at Tule
Diversion Dam and Doyle Springs
Diversion Dam.
