The Environmental Protection
Agency (EPA) is proposing to approve
portions of submissions from Alabama,
Mississippi, and South Carolina for
inclusion into each State’s
implementation plan. This proposed
action pertains to the Clean Air Act
(CAA or Act) infrastructure
requirements for the 2008 8-hour ozone
National Ambient Air Quality Standards
(NAAQS). The CAA requires that each
state adopt and submit a state
implementation plan (SIP) for the
implementation, maintenance, and
enforcement of each NAAQS
promulgated by EPA. These
submissions are commonly referred to
as ‘‘infrastructure SIPs submissions.’’
Specifically, EPA is proposing to
approve the portions of the submissions
from Alabama, Mississippi, and South
Carolina that pertain to a certain
visibility requirement related to the
2008 8-hour ozone infrastructure SIPs
for each state. All other applicable
infrastructure requirements for the 2008
8-hour ozone NAAQS associated with
these States’ infrastructure submissions
have been or will be addressed in
separate rulemakings. In the Rules and
Regulations section of this Federal
Register, EPA is approving the State’s
implementation plan revision as a direct
final rule without prior proposal
because the Agency views this as a
noncontroversial submittal and
anticipates no adverse comments. A
detailed rationale for the approval is set
forth in the direct final rule. If EPA
receives adverse comments, the direct
final rule will be withdrawn and all
public comments received will be
addressed in a subsequent final rule
based on this proposed rule.
