Description of Request: The licensee proposes to increase the installed capacity at one of the project's developments, the existing 5.6 megawatt (MW) Lyons Falls Mill Development. The proposed work would consist of: (1) Demolishing the existing four-unit primary powerhouse and mothball the secondary single-unit powerhouse; (2) constructing a new 60 feet long, 45 feet wide, and 40 feet high, combined intake and trashrack structure adjacent to the river left dam abutment; (3) constructing two 11.5-foot-diameter, 75- foot-long steel penstocks; (4) constructing a new concrete and masonry powerhouse located along river left, largely in the footprint of the existing primary powerhouse, with two generating units. The proposed work at the Lyons Falls development would increase its installed capacity from 5.6 MW to 11.2 MW and its hydraulic capacity from 1170 cubic feet per second (cfs) to 2684 cfs. The licensee provided documentation that on June 1, 2015, it has submitted a Joint Application for Permit to the New York State Department of Conservation (NYSDEC) in support of amending the Project's existing Section 401 Water Quality Certificate or issuing a new Water Quality Certificate for the Project. l. All comments, motions to intervene, recommendations, terms and conditions, or prescriptions must set forth their evidentiary basis and otherwise comply with the requirements of 18 CFR 4.34(b), and should relate to project works which are the subject of the license amendment. A copy of any protest or motion to intervene must be served upon each representative of the applicant specified in the particular application.
