Officials of TVA have determined
that:
• Pursuant to 25 U.S.C. 3001(9), the
human remains described in this notice
are Native American based on their
presence in prehistoric archeological
contexts.
• Pursuant to 25 U.S.C. 3001(9), the
human remains described in this notice
represent the physical remains of 12
individuals of Native American
ancestry.
• Pursuant to 25 U.S.C. 3001(2), a
relationship of shared group identity
cannot be reasonably traced between the
Native American human remains and
any present-day Indian tribe.
• According to final judgments of the
Indian Claims Commission or the Court
of Federal Claims, the land from which
the Native American human remains
were removed is the aboriginal land of
the Cherokee Nation, Eastern Band of
Cherokee Indians, and the United
Keetoowah Band of Cherokee Indians in
Oklahoma.
• Pursuant to 43 CFR 10.11(c)(1)(ii),
TVA has decided to transfer control of
the culturally unidentifiable human
remains to the Cherokee Nation, Eastern
Band of Cherokee Indians, and the
United Keetoowah Band of Cherokee
Indians in Oklahoma.

Consultation
A detailed assessment of the human
remains was made by the University of
Denver Museum of Anthropology
professional staff in consultation with
representatives of tribes with aboriginal
territory in Wyoming. The consultant
tribes with aboriginal territory in
Wyoming include: Arapaho Tribe of the
Wind River Reservation, Wyoming;
Cheyenne and Arapaho Tribes,
Oklahoma (previously listed as the
Cheyenne-Arapaho Tribes of
Oklahoma); Crow Tribe of Montana; Ely

Indian Community of the Fort Belknap

History and Description of the Remains
At an unknown date, human remains
representing, at minimum, 1 individual
were removed from an unknown site in
Wyoming. Theodore Sowers collected
the human remains in the 1930s during
fieldwork led by Dr. E.B. Renaud of the
University of Denver Department of
Anthropology. Mr. Sowers’ daughters,
Katy Sickles and Jenny Bauer, donated
the human remains to the University of
Denver Museum of Anthropology in
August, 1995, to facilitate repatriation.
A napkin with the inscription ‘‘A
Katenia’’ and male/female symbols were
found with the remains upon donation.
No known individuals were identified.
No associated funerary objects are
present.
Pursuant to 43 CFR 10.16, the
Secretary of the Interior may make a
recommendation for a transfer of control
of culturally unidentifiable human
remains. In November 2014, the
University of Denver Museum of
Anthropology requested that the

Review Committee, recommend the
proposed transfer of control of the
culturally unidentifiable Native
American human remains in this notice
to the Arapaho Tribe of the Wind River
Reservation, Wyoming; and the
Shoshone Tribe of the Wind River
Reservation, Wyoming. The Review
Committee, acting pursuant to its
responsibility under 25 U.S.C.
3006(c)(5), considered the request at its
November 2014 meeting and
recommended to the Secretary that the
proposed transfer of control proceed. A
December 29, 2014 letter on behalf of
the Secretary of Interior from the
Associate Director, Cultural Resources,
Partnerships, and Science transmitted
the Secretary’s independent review and
concurrence with the Review
Committee that:
• The University of Denver Museum
of Anthropology consulted with every
appropriate Indian tribe or Native
Hawaiian organization,
• none of The Consulted and Notified
Tribes objected to the proposed transfer
of control, and
• the University of Denver Museum
of Anthropology may proceed with the
agreed upon transfer of control of the
culturally unidentifiable human
remains to the Arapaho Tribe of the
Wind River Reservation, Wyoming; and
the Shoshone Tribe of the Wind River
Reservation, Wyoming.
Transfer of control is contingent on
the publication of a Notice of Inventory
Completion in the Federal Register.
This notice fulfills that requirement.
