Nonmanufacturer Rule. 13 CFR
121.406(b), 125.15(c). Section
8(a)(17)(b)(iv) of the Act authorizes SBA
to waive the Nonmanufacturer Rule for
any ‘‘class of products’’ for which there
are no small business manufacturers or
processors available to participate in the
Federal market.
In order to be considered available to
participate in the Federal market for a
class of products, a small business
manufacturer must have submitted a
proposal for a contract solicitation or
received a contract from the Federal
government within the last 24 months.
13 CFR 121.1202(c). The SBA defines
‘‘class of products’’ based on the Office
of Management and Budget’s NAICS.
The SBA is currently processing a
request to waive the Nonmanufacturer
Rule for Scientific Vacuum Pumps,
under NAICS code 333911 (Pump and
Pumping Equipment Manufacturing),
PSC 4310 (Compressors and Vacuum
Pumps). The public is invited to
comment or provide source information
to SBA on the proposed waiver of the
Nonmanufacturer Rule for the product
within 15 days after date of publication
in the Federal Register and on
FedBizOpps.gov. More information
about the Nonmanufacturer Rule and

Abstract of proposed collection:
The information collected from
individuals and organizations is
specifically used to conduct screening
to ensure that State funded activities do
not provide support to entities or
individuals deemed to be a risk to
national security.
Methodology:
The State Department has
implemented a Risk Analysis and
Management Program to vet potential
contractors and grantees seeking
funding from the Department of State to
mitigate the risk that such funds might
benefit entities or individuals who
present a national security risk. To
conduct this vetting program the
Department collects information from
contractors, sub-contractors, grantees
and sub-grantees regarding their
directors, officers and/or key employees
through mail, fax or electronic
submission. The information collected
is compared to information gathered
from commercial, public, and U.S.
government databases to determine the
risk that the applying organization,
entity or individual might use
Department funds or programs in a way
that presents a threat to national
security. This program will continue as
a pilot program as directed by Congress
in the Department of State, Foreign
Operations, and Related Programs
Appropriations Act, 2015 (Div. J, Pub. L.
113–235).
