825(e) and Rule 206 of the Federal
Energy Regulatory Commission’s
(Commission) Rules of Practice and
Procedure, 18 CFR 385.206, Otter Tail
Power Company (Complainant), filed a
formal complaint against Midcontinent
Independent System Operator, Inc.
(Respondent), alleging that the
Respondent’s Open Access
Transmission, Energy and Operating
Reserve Markets Tariff is unjust and
unreasonable to the extent that the pro
forma Facilities Construction
Agreement contained therein does not

permit an affected system operator to
elect to self-fund Network Upgrades, as
more fully explained in the complaint.
The Complainant certifies that copies
of the complaint were served on the
