k. Description of Project: The existing
7.5-kilowatt run-of-river Horseshoe
Bend Water Turbine Project consists of:
(1) A two to three-foot-high dam on
Billy Creek, a tributary of the Salmon
River; (2) a 6-inch-diameter pipe which
transfers water from a reservoir which
holds 2,000 gallons of water to a holding
tank; (3) a 6-inch-diameter overflow
pipe which diverts water from the
holding tank into Billy Creek; (4) a 3 to
4-inch diameter, 3,800-foot-long
penstock; (5) a turbine rated at 400 feet
of net head coupled to a generator with
an average flow of .37 cubic feet per
second; (6) a 6-inch-diameter tailrace
which returns water back into Billy
Creek; (7) and appurtenant facilities.
The project intake starts on the
applicant’s property and continues
through lands owned by the State of
Idaho and the Bureau of Land
Management.
When a Declaration of Intention is
filed with the Federal Energy Regulatory
Commission, the Federal Power Act
requires the Commission to investigate
and determine if the project would
affect the interests of interstate or
foreign commerce. The Commission also
determines whether or not the project:
(1) Would be located on a navigable
waterway; (2) would occupy public
lands or reservations of the United
States; (3) would utilize surplus water
or water power from a government dam;
or (4) would be located on a nonnavigable stream over which Congress
has Commerce Clause jurisdiction and
would be constructed or enlarged after
1935.
