Title: Bank Secrecy Act Suspicious
Activity Report (BSA–SAR).
Abstract: The statute generally
referred to as the ‘‘Bank Secrecy Act,’’
Titles I and II of Public Law 91–508, as
amended, codified at 12 U.S.C. 1829b,
12 U.S.C. 1951–1959, and 31 U.S.C.
5311–5332, authorizes the Secretary of
the Treasury, among other things, to
require financial institutions to keep
records and file reports that are
determined to have a high degree of
usefulness in criminal, tax, and
regulatory matters, or in the conduct of
intelligence or counter-intelligence
activities, to protect against
international terrorism, and to
implement anti-money laundering
programs and compliance procedures.
Regulations implementing Title II of the
BSA appear at 31 CFR Chapter X. The
authority of the Secretary to administer
the BSA has been delegated to the
Director of FinCEN.
The information collected on the
‘‘report’’ is required to be provided
pursuant to 31 U.S.C. 5318(g), as
implemented by FinCEN regulations
found at 31 CFR 1020.320, 1021.320,
1022.320, 1023.320, 1024.320, 1025.320,
1026.320, 1029.320. The information
collected under this requirement is
made available to appropriate agencies
and organizations as disclosed in
FinCEN’s Privacy Act System of Records
Notice relating to BSA Reports.

Abstract: Authorized under the
American Recovery and Reinvestment
Act (ARRA) (Pub. L. 111–5), the
Department of the Treasury
implemented several provisions of the
Act, more specifically Division B—Tax,
Unemployment, Health, State Fiscal
Relief, and Other Provisions. Among
these components is a program which
requires Treasury to make payments, in
lieu of a tax credit, to state housing
credit agencies. State housing credit
agencies use the funds to make
subawards to finance the construction
or acquisition and rehabilitation of
qualified low-income buildings. The
collection of information from the
agencies is necessary to properly
monitor compliance with program
requirements.

Tax Purposes.
Form: 706–GS(T).
Abstract: Form 706–GS(T) is used by
a trustee to figure and report the tax due
from certain trust terminations that are
subject to the generation-skipping
transfer (GST) tax. Where Form 706–
GS(T) is used, the filer should attach a
Notice of Qualified Severance to the
return that clearly identifies the trust
that is being severed and the new trusts
created as a result of the severance. The
Notice must also provide the inclusion
ratio of the trust that was severed and
the inclusion ratios of the new trusts
resulting from the severance. The
information collected will be used by
the IRS to identify the trusts being
severed and the new trusts created upon
severance.
