The Environmental Protection
Agency’s (EPA) Environmental
Financial Advisory Board (EFAB) will
hold a public meeting on October 28–
29, 2014. EFAB is an EPA advisory
committee chartered under the Federal
Advisory Committee Act (FACA) to
provide advice and recommendations to
EPA on creative approaches to funding
environmental programs, projects, and
activities.
The purpose of this meeting is to hear
from informed speakers on
environmental finance issues, proposed
legislation, and EPA priorities; to
discuss activities, progress, and
preliminary recommendations with
regard to current EFAB work projects;

I. Additional Information About the
Proposed Consent Decree
The proposed consent decree would
resolve a lawsuit filed by the Sierra Club
seeking to compel the Administrator to
take action under CAA sections
110(c)(1)(A). Under the terms of the
proposed consent decree, EPA would
agree to sign a notice by no later than
November 7, 2014, to promulgate a FIP
for Montana’s PSD program that
addresses nitrogen oxides as an ozone
precursor. The consent decree further
provides that EPA shall have complied
with this obligation if EPA signs by the
same date a notice or notices
collectively satisfying the PSD
requirements in CAA section
110(a)(2)(C) and (J) for the 1997 ozone
NAAQS, including unconditionally
approving a state implementation plan
(‘‘SIP’’) or promulgating a partial FIP
and unconditionally approving a partial
SIP.
Under the terms of the proposed
consent decree, EPA will deliver notice
of the action to the Office of the Federal
Register for review and publication
within 15 business days of signature. In
addition, the proposed consent decree
outlines the procedure for the Plaintiff
to request costs of litigation, including
attorney fees.
For a period of thirty (30) days
following the date of publication of this
notice, the Agency will accept written
comments relating to the proposed
consent decree from persons who are
not named as parties or intervenors to
the litigation in question. EPA or the
Department of Justice may withdraw or
withhold consent to the proposed
consent decree if the comments disclose
facts or considerations that indicate that
such consent is inappropriate,
improper, inadequate, or inconsistent
with the requirements of the Act. Unless
EPA or the Department of Justice
determines that consent to this consent
decree should be withdrawn or
withheld, the terms of the consent
decree will be affirmed.
