II. Summary of Errors in the Regulations Text On page 50906 of the FY 2014 IPPS/ LTCH PPS final rule in our discussion of the change to the Medicare Hospital Conditions of Participation (CoPs) relating to the administration of pneumococcal vaccines, we stated that we were finalizing our proposal to remove the term ‘‘polyscaccharide’’ from the regulatory language at § 482.23(c). Therefore on page 50970 in the amendatory instructions for § 482.23, we stated that we were revising paragraph (c)(3). In stating that we were revising paragraph (c)(3), we revised the language to remove the term ‘‘polyscaccharide,’’ but we also removed paragraphs (c)(3)(i), (ii), and (iii). To correct this error, in the regulations text of this correcting amendment, we are adding the inadvertently removed paragraphs (that is, paragraphs (c)(3)(i) through (c)(3)(iii)). III. Waiver of Proposed Rulemaking and Delay in Effective Date We ordinarily publish a notice of proposed rulemaking in the Federal Register to provide a period for public comment before the provisions of a rule take effect in accordance with section 553(b) of the Administrative Procedure Act (APA) (5 U.S.C. 553(b)). However, we can waive this notice and comment procedure if the Secretary finds, for good cause, that the notice and comment process is impracticable, unnecessary, or contrary to the public interest, and incorporates a statement of the finding and the reasons therefore in the notice.
