On December 5, 2012, Plaintiffs filed a complaint alleging that Gina McCarthy, in her official capacity as Administrator of the United States Environmental Protection Agency (‘‘EPA’’), failed to perform a mandatory duty to respond to a 2009 certification by the Department of the Interior (‘‘DOI’’) that visibility impairment in Minnesota’s Voyageurs National Park and Michigan’s Isle Royale National Park is reasonably attributable to emissions from Xcel Energy’s coal-fired Sherburne County Generating Station (‘‘Sherco’’) in Minnesota.
