A. Purpose
This information collection is
necessary in order to comply with
section 872 of the Duncan Hunter
National Defense Authorization Act of
2009, Public Law 110–417, as amended
by Public Law 111–212, hereafter
referred to as ‘‘the Act.’’ The Act
requires GSA to establish and maintain
a database of information regarding the
integrity and performance of certain
entities awarded Federal grants and
contracts and use of the information by
Federal officials making awards. OMB
proposed implementing guidance for
grants and cooperative agreements on
February 18, 2010 (75 FR 7316). That
guidance is in the process of being
finalized. The proposed guidance
requires appropriate Federal officials to
report on terminations of awards due to
material failure to comply with award
terms and conditions; administrative
agreements with entities to resolve
suspension or debarment proceedings;
and findings that entities were not
qualified to receive awards. Through a
new award term, each recipient would
provide information about certain civil,
criminal, and administrative
proceedings that reached final
disposition within the most recent fiveyear period and were connected with
the award or performance of a Federal
or State award. As section 872 requires,
an entity also would be able to submit
comments to the data system about any
information that the system contains
about the entity.
