responsibilities for affected species, and
in consideration of section 10(a)(1)(A) of
the Endangered Species Act of 1973, as
amended (16 U.S.C. 1531 et seq.), and
the Marine Mammal Protection Act of
1972, as amended (16 U.S.C. 1361 et
seq.), along with Executive Order 13576,
‘‘Delivering an Efficient, Effective, and
Accountable Government,’’ and the
President’s Memorandum for the Heads
of Executive Departments and Agencies
of January 21, 2009—Transparency and

26, 2009), which call on all Federal
agencies to promote openness and
transparency in Government by

Notice is hereby given that a
complaint was filed with the U.S.
International Trade Commission on
December 18, 2013, under section 337 of
the Tariff Act of 1930, as amended, 19
U.S.C. 1337, on behalf of Pragmatus
Mobile, LLC of Alexandria, Virginia.
Letters supplementing the complaint
were filed on January 2 and 8, 2014. The
complaint alleges violations of section
337 based upon the importation into the
United States, the sale for importation,
and the sale within the United States
after importation of certain wireless
devices, including mobile phones and
tablets by reason of infringement of U.S.
Patent No. 8,149,124 (‘‘the ’124 patent’’)
and U.S. Patent No. 8,466,795 (‘‘the ’795
patent’’). The complaint further alleges
that an industry in the United States
exists as required by subsection (a)(2) of
section 337.
The complainant requests that the
Commission institute an investigation
and, after the investigation, issue a
limited exclusion order and cease and
desist orders.
