Louisiana; Notice of Availability of the
Final Environmental Impact Statement
for the Toledo Bend Hydroelectric
Project
In accordance with the National
Environmental Policy Act of 1969 and
the Federal Energy Regulatory
Commission (Commission or FERC)
regulations contained in the Code of
Federal Regulations (CFR) (18 CFR part
380), the Office of Energy Projects has
reviewed the application for license for
the Toledo Bend Hydroelectric Project
(FERC No. 2305) and has prepared a
final environmental impact statement
(EIS) for the project.
The existing project is located on the
Sabine River between river mile (RM)
147 and RM 279, affecting lands and
waters in Panola, Shelby, Sabine, and
Newton Counties, Texas, and De Soto,
Sabine, and Vernon Parishes, Louisiana.
The project occupies lands within the
Sabine National Forest in Texas and the
Indian Mounds Wilderness Area,
administered by the U.S. Department of
Agriculture—Forest Service.
The final EIS contains staff’s analysis
of the applicants’ proposals and the
alternatives for relicensing the Toledo
Bend Project. The final EIS documents
the views of governmental agencies,
non-governmental organizations,
affected Indian tribes, the public, the
license applicants, and Commission
staff.

that will allow an EQR filer to file its

making filings in the test sandbox.
However, in an effort to assure robust
testing by users, staff would like to
allow the public additional time to test
the new system after having the benefit

reason, staff anticipates that the first
filings under the new system (for 3Q

deadline will be forthcoming in a
subsequent notice.

the agenda for the technical conference
will be posted prior to the conference on
the Calendar of Events on the
Commission’s Web site, www.ferc.gov.
A free webcast of the conference will
be available through www.ferc.gov.

This constitutes notice, in accordance
with 18 CFR 385.2201(b), of the receipt
of prohibited and exempt off-the-record
communications.
Order No. 607 (64 FR 51222,
September 22, 1999) requires
Commission decisional employees, who
make or receive a prohibited or exempt
off-the-record communication relevant
to the merits of a contested proceeding,
to deliver to the Secretary of the
Commission, a copy of the
communication, if written, or a
summary of the substance of any oral
communication.
Prohibited communications are
included in a public, non-decisional file
associated with, but not a part of, the
decisional record of the proceeding.
Unless the Commission determines that
the prohibited communication and any
responses thereto should become a part
of the decisional record, the prohibited

off-the-record communication will not
be considered by the Commission in
reaching its decision. Parties to a
proceeding may seek the opportunity to
respond to any facts or contentions
made in a prohibited off-the-record
communication, and may request that
the Commission place the prohibited
communication and responses thereto
in the decisional record. The
Commission will grant such a request
only when it determines that fairness so
requires. Any person identified below as
having made a prohibited off-the-record
communication shall serve the
document on all parties listed on the
official service list for the applicable
proceeding in accordance with Rule

conference on the Revisions to Electric Quarterly Report (EQR) Filing
