    On May 28, 2013, KC Scoby Hydro, LLC, filed an application for a 
preliminary permit, pursuant to section 4(f) of the Federal Power Act 
(FPA), proposing to study the feasibility of hydropower at the existing 
Union Street Dam located on the Dan River in the City of Danville, 
Virginia. On August 28, 2013, the Commission issued a Notice of 
Acceptance of the May 28, 2013, application and sent an acceptance
